By accessing or using any Charting Compass product or service, you agree to be bound by these comprehensive terms.

Scope of Agreement
This agreement governs your use of all products and services offered by Charting Compass, LLC, including but not limited to:
- Workflow automation software development
- Data visualization tools and dashboard design
- AI-powered desktop application creation
- Custom reporting and market analysis platforms
- TradingView integration solutions and automated charting
Acceptance of Terms
Your acceptance of these terms occurs upon your first use of any Charting Compass service, execution of a service contract, or activation of a licensed product. If you do not agree to these terms, you must not use our services.

- "Service(s)": Refers to all software, tools, platforms, and consultancy provided by Charting Compass.
- "User," "You," "Your": Refers to the individual or entity accessing or using the Services.

Service Usage Rights and Restrictions

Charting Compass grants you a non-exclusive, non-transferable, limited license to access and use the Services strictly in accordance with the terms of your specific service agreement or subscription plan. You may not reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of any Charting Compass software. Redistribution, resale, or sublicensing of our services without express written consent is strictly prohibited. Misuse includes engaging in fraudulent activities, distributing malware, or interfering with service integrity, which violate our fintech policies.

All intellectual property rights in the Services, including proprietary algorithms, charting software, and design elements, belong exclusively to Charting Compass. Your data, however, remains solely yours. We process and store your data in accordance with our Privacy Policy and relevant financial industry regulations.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Billing, Payment, and Cancellation Policies

Pricing and Payment Structure
Our pricing models vary by service, typically structured as monthly or annual subscriptions for software licenses and project-based fees for custom development. Detailed fee schedules are provided in your signed service agreement. We accept all major credit cards and bank transfers.

Billing Cycles and Late Payments
Subscription services are billed in advance, either monthly or annually, based on your agreement. Custom project milestones incur billing upon completion as per the project plan. Late payments may be subject to a 1.5% monthly interest charge or the maximum allowed by law, and may result in temporary service interruption.

Cancellation and Termination
You may cancel your subscription at any time with 30 days written notice prior to the next billing cycle. For custom projects, termination clauses are outlined in your specific project contract. Upon termination, access to services will cease, and any outstanding balances become immediately due.

Refund Policies and Renewals
Refunds are issued solely at the discretion of Charting Compass and generally apply only if a service fault attributable to us prevents agreed-upon functionality. Annual subscriptions automatically renew unless canceled as per the notice period. You will receive a reminder before auto-renewal.

Warranties, Limitations, and Liability

Limitation of Liability
To the maximum extent permitted by law, Charting Compass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Services. Our total aggregate liability for any claims arising under these terms shall not exceed the amount paid by you for the Services in the twelve (12) months preceding the claim.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CHARTING COMPASS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
Indemnification
You agree to indemnify and hold harmless Charting Compass, its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Services, your violation of these terms, or your infringement of any third-party rights.
Force Majeure
Charting Compass shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, labor disputes, governmental acts, and internet outages. We will make reasonable efforts to mitigate the effects of such events.
Dispute Resolution and Legal Contact

Dispute Resolution Procedures
Any dispute, controversy, or claim arising out of or relating to these terms, or the breach thereof, shall first be addressed through good faith negotiations between the parties. If an amicable resolution cannot be reached within sixty (60) days, the dispute shall be submitted to binding arbitration in Tampa, Florida, in accordance with the rules of the American Arbitration Association. The decision of the arbitrator shall be final and binding.
Governing Law and Jurisdiction
These terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Exclusive jurisdiction for any legal action or proceeding not subject to arbitration shall be in the state or federal courts located in Hillsborough County, Florida.
Amendments and Severability
Charting Compass reserves the right to amend these terms at any time by posting the revised terms on our website. Your continued use of the Services after such posting constitutes your acceptance of the revised terms. If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms will otherwise remain in full force and effect.
